General Terms and Conditions of Sale vzw Stoomcentrum Maldegem

1.  General

These terms and conditions apply to all sales transactions conducted by the association ‘vzw Stoomcentrum Maldegem’, located at Stationsplein 8, 9990 Maldegem, hereinafter referred to as ‘Stoomtrein Maldegem-Eeklo’.
These conditions take precedence over any purchase terms of the buyer, unless explicitly agreed otherwise with ‘Stoomtrein Maldegem-Eeklo’, even if the association has not expressly rejected such conditions.
By placing an order, the purchaser agrees to these terms and conditions.

2.  Products and services

All products and services are subject to availability. If a product is unavailable, the purchaser will be informed.

3.  Prices

Prices for products and/or services are clearly stated on the website or other sales materials.
Prices include VAT unless otherwise specified.
‘Stoomtrein Maldegem-Eeklo’ reserves the right to change prices at any time; however, the price valid at the time of the order will apply.

4.  Orders and payment

Orders for physical goods from the shop may be placed online at www.stoomtreinmaldegem.be or purchased on site.
Tickets for special events (such as the Oriënt Dining Express or St. Nicholas trains) must be purchased online only.
Online payments must be made using the methods indicated on the website.
Orders will be processed after payment is received. Bank transfers may take longer to process.
Tickets for regular train rides during the season (early May to late September) can also be purchased and paid for on site via Bancontact or cash.
The purchaser is responsible for providing accurate delivery details.

5.  Delivery

Physical goods (shop items) will be delivered to the address provided by the purchaser, unless otherwise agreed.
‘Stoomtrein Maldegem-Eeklo’ is not liable for damage, loss, or theft caused by the delivery service.
Tickets will be sent digitally by email to the address provided by the customer.
While ‘Stoomtrein Maldegem-Eeklo’ endeavours to dispatch orders within the stated timeframe, it cannot be held responsible for delays beyond its control.
Shipping costs, if applicable, are listed separately and are payable by the purchaser.

6.  Return and cancellation policy

Tickets for events (Festival, Orient Dining Express rides, St. Nicholas trains, etc.) can only be cancelled and refunded if the request is made at least 14 days prior to the event.
No refunds are granted within 14 days of the event, including in cases of illness or accident. Customers may arrange for someone else (family, friends, neighbours) to attend in their place. ‘Stoomtrein Maldegem-Eeklo’ does not have cancellation insurance.
Tickets for regular rides (early May to late September) are non-refundable, even in case of illness or accident. Upon customer request, and at the latest on the day stated on the ticket, the date may be changed to another operating day.
For physical shop items, purchasers have the right to cancel the purchase within 14 days of receipt without giving a reason, provided the item is unused, undamaged, and returned in its original packaging.
Return shipping costs are the purchaser’s responsibility unless the item is returned on-site to the ticket office on a ride day.

7.  Warranty

‘Stoomtrein Maldegem-Eeklo’ guarantees the good quality of purchased physical shop items.
Upon receipt, the purchaser must immediately inspect the items. Any damage must be reported within 14 days with proper evidence.
In such cases, the purchaser is entitled to a free replacement.
Claims submitted after 14 days from delivery will not be accepted, and the purchaser is considered to have accepted the item in good condition.
The warranty does not cover damage due to misuse or wear and tear.

8.  Liability

‘Stoomtrein Maldegem-Eeklo’ is not liable for any damage resulting from the use of products or services, except in cases of gross negligence or wilful misconduct.
Liability is limited to the amount paid by the purchaser for the relevant product or service.

9.  Privacy

‘Stoomtrein Maldegem-Eeklo’ respects customers’ privacy and processes personal data in accordance with applicable data protection laws (such as GDPR).
Customer data is used solely for order fulfilment and is not shared with third parties without consent.

10.  Law and disputes

Consumers have a statutory right to withdraw from distance contracts within 14 calendar days without penalty or reason. This withdrawal period begins the day after delivery.
Customers are only liable for direct costs of returning goods to exercise this right.
‘Stoomtrein Maldegem-Eeklo’ may update these terms and service specifications, including prices, at any time. New prices apply only to orders placed after changes.
Belgian law governs all agreements.
Disputes will preferably be resolved amicably; failing which, they will be submitted to the competent court in the district where the association is based.
